TERMS AND CONDITIONS & REFUND POLICY

Effective Date: July 31, 2023
Organization: American Academy of Ultrasound Technology (aausTech)

1. ACCEPTANCE OF TERMS

By completing your registration and payment, you (the “Student”) agree to be legally bound by
these Terms and Conditions. Access to aausTech’s proprietary platform and educational
materials is strictly contingent upon your acceptance of these terms.

2. INTELLECTUAL PROPERTY & CONFIDENTIALITY

All course materialsβ€”including video lectures, ultrasound images, text, and diagramsβ€”are the
exclusive confidential property of aausTech.

β€’ Limited License: Students are granted a single-user, non-transferable license for
personal educational use only.
β€’ Prohibitions: You may not record, screen-capture, share login credentials, or redistribute
any content. Violation of this clause will result in immediate termination of access
without notice or refund.

3. CANCELLATION AND REFUND POLICY

To maintain the integrity of our proprietary medical curriculum and protect our confidential
training materials, aausTech enforces a strict non-refundable policy based on the provision of
digital access:

β€’ Pre-Access Cancellation: A refund request will only be considered if submitted in
writing to info@aaustech.com within 24 hours of payment, provided that account
credentials and digital access have not yet been issued.
β€’ Irrevocable Access (Final Sale): “Full Access” is defined as the moment aausTech
generates and delivers login credentials or digital course materials to the student’s
registered email address. Once this delivery occurs, the course is deemed “Consumed”
and the transaction is 100% non-refundable.
β€’ Non-Usage Clause: This policy applies regardless of whether the student has actually
logged into the portal, downloaded files, or viewed any video content. The availability of
access to confidential intellectual property constitutes a completed transfer of value.
β€’ Chargeback Waiver: By accepting these terms and gaining access to our confidential
proprietary data, the student acknowledges the immediate transfer of value and expressly
waives their right to dispute the transaction via their bank or credit card provider
(chargeback) based on “non-use,” “change of mind,” or “unauthorized access” once
credentials have been sent.

4. TECHNICAL RESPONSIBILITY

It is the student’s responsibility to ensure they have the required hardware, software, and stable
internet connection to access the course. Technical issues on the user’s end do not qualify for a
refund.

5. LIMITATION OF LIABILITY

aausTech and its affiliates shall not be liable for any indirect, incidental, or consequential
damages resulting from the use or inability to use the course materials. aausTech provides
specialized education but does not guarantee employment or specific state licensure.

6. FORCE MAJEURE

aausTech shall not be held liable for interruptions in service caused by factors beyond its
reasonable control, including server outages, provider failures, or natural disasters.

7. GOVERNING LAW

These Terms and Conditions shall be governed by and construed in accordance with the laws of
the State of Iowa, United States, without regard to conflict of law principles. Any legal disputes
shall be settled exclusively in the state or federal courts located in Iowa.
